Purpose of the site

Immovix operates a marketplace on which property management companies and developers advertise homes to rent or buy. Immovix is neither landlord nor seller, and does not act as a broker within the meaning of Art. 412 et seq. of the Swiss Code of Obligations. Contracts are concluded solely between the person searching and the agency concerned.

Responsibility for content

Listings come from the agencies that publish them. Immovix verifies agencies before activation but does not write listing content and gives no warranty as to its accuracy. Anyone finding an unlawful or misleading listing is asked to report it to missbrauch@immovix.ch — we review every report and remove listings that prove inadmissible.

The text, design and software of this site are protected by copyright. Property photographs belong to the respective agencies or their photographers and may not be reused without their consent.

Privacy policy

This policy sets out what personal data Immovix processes, for what purpose, and who receives it. It follows the revised Swiss Federal Act on Data Protection (FADP) and its ordinance (DPO), both in force since 1 September 2023.

Controller

The controller is Immovix AG, PLACEHOLDER — Strasse und Nummer, 8001 Zürich. Please direct data protection questions to datenschutz@immovix.ch.

What we process

  • Server logs: IP address, timestamp, page requested, browser and operating system. These arise technically on every request and serve operation and attack defence.
  • Agency account and contract data: company, UID, address, contact person, email, telephone, subscription and billing details.
  • Listing data: the property details and photographs entered by agencies.
  • Usage data: searches, filters and listings viewed, where you have consented to measurement.
  • Consent state: your choice in the cookie banner, so that we can honour it.

Your watchlist and recently viewed homes stay in your browser (localStorage) and are never sent to us. Searching without an account creates no profile with us.

Application documents

Immovix stores no application dossiers. When you apply, your own mail application opens with the subject and body prepared; you attach the files yourself and the email goes straight to the agency. Debt-collection extracts, payslips and ID copies therefore never reach our systems — this platform has no upload function at all.

Purposes

  • Operating, securing and stabilising the platform.
  • Performing the contract with agencies, including billing.
  • Verifying agencies before their listings go live.
  • Improving the service using aggregated usage statistics, where consented.
  • Meeting legal obligations, in particular the ten-year retention of business records under Art. 958f CO.

Cookies and measurement

Strictly necessary cookies hold your language, your consent and your session; without them the site does not work. Everything else — audience and advertising measurement — is off by default and is only set once you explicitly agree in the banner. You can change your choice at any time through "Cookie settings" in the footer. Art. 45c(b) of the Telecommunications Act requires information and an opt-out in Switzerland; we deliberately go further and ask first.

Transfers abroad

As the table shows, our providers are outside Switzerland. Under Art. 16 FADP a disclosure is permitted where the receiving state offers adequate protection — the Federal Council lists those states in Annex 1 DPO, including the EEA and Israel. For the United States, the Federal Council has recognised adequate protection since 15 September 2024 for companies certified under the Swiss–U.S. Data Privacy Framework. Where a provider is not certified, we rely on Art. 16(2)(d) FADP, using the European Commission’s standard contractual clauses together with the FDPIC’s Swiss addendum.

We do not claim your data never leaves Switzerland. The map deliberately takes its tiles from swisstopo rather than a foreign provider, but hosting, database and payment processing sit with the companies named above.

Retention

  • Server logs: generally 90 days, then deleted or anonymised.
  • Account and listing data: for the duration of the contractual relationship.
  • Invoicing and accounting data: ten years, under Art. 958f CO.
  • Consents: six months from your choice, after which we ask again.

Your rights

You have the right to access the data we hold about you (Art. 25 FADP), to rectification and erasure (Art. 32 FADP), to object to processing, and to receive or transfer your data (Art. 28 FADP). Write to datenschutz@immovix.ch. Access is free of charge as a rule and we answer within 30 days. For your own protection we must verify your identity before releasing data.

If our answer does not satisfy you, you may approach the Federal Data Protection and Information Commissioner (FDPIC), Feldeggweg 1, 3003 Bern or bring civil proceedings.

Automated decisions

No automated individual decision within the meaning of Art. 21 FADP takes place. Agency verification before activation is carried out by people.

Security and breach notification

We take appropriate technical and organisational measures under Art. 8 FADP, including transport encryption throughout, access restriction and logging. Where a data security breach is likely to result in a high risk to your personality, we notify the FDPIC as quickly as possible under Art. 24 FADP and inform you where needed for your protection.

Changes

We update this policy when the platform or its providers change. The version published here is the one that applies.

Terms and conditions

These terms govern use of the Immovix platform — free for people searching, paid for agencies that publish listings.

1. Scope and parties

These terms apply between Immovix AG ("Immovix") and everyone who uses the platform. For agencies, the service descriptions and prices shown at the time of booking apply in addition.

2. Immovix's role

Immovix provides a platform on which agencies advertise properties. Immovix is not a party to the tenancy or sale agreement, does not act as a broker under Art. 412 et seq. CO, and owes no brokerage result. Use is free for people searching; Immovix charges them neither commission nor fees.

3. Agency obligations

  • Listings must be truthful, complete and current. Net rent and service charges must be stated separately and correctly.
  • Only genuinely available properties may be advertised. Let properties must be deactivated without delay.
  • Photographs must show the advertised property and must be usable; the agency warrants that it holds the necessary rights.
  • For residential property the deposit may not exceed three net monthly rents (Art. 257e CO). Listings with a higher deposit are rejected.
  • Company and contact details must be accurate. Before activation we call a telephone number published on the agency's own website.

4. Verification and what it means

Immovix verifies the identity of the agency before activation. That check concerns the agency, not the condition of a flat: Immovix does not inspect properties and warrants neither their condition nor the accuracy of individual details. Where a condition ceases to be met, Immovix may deactivate listings without notice.

5. Inadmissible content

Prohibited in particular are false or misleading statements, discriminatory wording, sham listings, demanding payment before a viewing, and systematic scraping of the platform. Immovix may remove such content and block accounts.

6. Prices, VAT and payment

The prices published at the time of booking apply. Unless stated otherwise, prices are exclusive of statutory VAT, currently 8.1%. Payment is processed by Stripe Payments Europe, Ltd.; card data is processed there alone and never by Immovix. In the event of late payment, Immovix may deactivate listings after a reminder.

7. Term and termination

Subscriptions run from booking for the period chosen and renew for the same period unless terminated before the end of the current one. Termination is done in the account or by email to kontakt@immovix.ch.

Swiss law provides no statutory right of withdrawal for contracts concluded online. Art. 40a et seq. CO covers only doorstep and comparable transactions and telephone sales, and does not extend to this contract.

8. Availability

Immovix aims for operation that is as uninterrupted as possible but owes no particular level of availability. Maintenance and faults at providers may cause interruptions.

9. Liability

Immovix is liable for damage caused by unlawful intent and gross negligence; excluding that would in any event be void under Art. 100(1) CO. For slight negligence, liability is excluded to the extent permitted by law. Immovix is not liable for the content of listings, for the conclusion or performance of tenancy and sale agreements, or for the conduct of agencies.

10. Reporting unlawful listings

Reports of unlawful or misleading listings are received at missbrauch@immovix.ch and reviewed. Where a report is confirmed, we remove the listing.

11. Changes

Immovix may amend these terms. Agencies with a running subscription are informed at least 30 days in advance; absent objection, the new terms apply from the next renewal.

12. Governing law and jurisdiction

Swiss law applies, excluding the Vienna Sales Convention (CISG). The place of jurisdiction is Zürich. Mandatory places of jurisdiction, in particular the consumer forum under Art. 32 CPC, are reserved.
